The jurisdiction chain:

  1. The State of Florida originally owned the community roads
  2. The State transferred road jurisdiction to the CDD (Community Development District)
  3. The HOA needs the CDD to relinquish road jurisdiction to the HOA so parking rules can be enforced
  4. This process is complex and expected to take a significant amount of time

In the meantime, residents continue to deal with overnight street parking that blocks visibility, emergency access, and creates neighborhood disputes. The HOA has acknowledged the problem but cannot act until the jurisdiction issue is resolved.

  • The overnight parking rule IS in the bylaws — it’s legitimate
  • The HOA physically cannot enforce it without road jurisdiction
